In its continuing crackdown, the SEC recently charged a former executive at Yahoo! Inc. and a former mutual fund manager at a subsidiary of Ameriprise Financial Inc. with insider trading on confidential information about a search engine partnership between Yahoo and Microsoft Corporation. In its complaint (see: http://sec.gov/litigation/complaints/2012/comp-pr2012-99.pdf), the SEC alleges that Robert W. Kwok, who was Yahoo’s senior director of business management, breached his duty to the company when he told Reema D. Shah in July 2009 that a deal between Yahoo and Microsoft would be announced soon.

Mitt Romney’s religion was a major stumbling block for his 2008 presidential aspirations, and remains so for his candidacy in 2012, according to David Campbell at the University of Notre Dame. Real time voter analysis of the 2008 primaries reveals that while the social barriers of race and gender were largely overcome during the last US presidential campaign, religious affiliation (in this case, the Church of Latter Day Saints) is still a significant hurdle. A new article in Springer’s journal, Political Behavior, suggests that a “stained glass ceiling” remains an obstacle to Mitt Romney’s 2012 bid for the White House …

 

Porter Novelli Wins Bid: Feds Sign $20M PR Contract to Promote Obamacare

The federal government has signed a contract with a public relations firm to spend $20 million to promote Obamacare, a law that made be defunct in a month.

The advertising campaign will educate the public on staying healthy and preventing illness, a Health and Human Services official told The Hill.

The controversial Affordable Care Act includes provisions for the advertising blitz in the law. The contract was won by the public relations firm Porter Novelli in a competitive bidding process, according to the Hill.

The Supreme Court is expected to rule on the constitutionality of the law before its recess in June …

Mobile Marketing Tipping Point? Google Acquires Motorola for $12.5b
BusinessWeek
Google Inc. on Tuesday completed its $12.5 billion acquisition of phone maker Motorola Mobility Holdings Inc. and said it has appointed a Google executive as the new CEO of the business.

Dennis Woodside, previously president of Google’s Americas region, is Motorola’s new CEO. Departing CEO Sanjay Jha will help to ensure a smooth transition, Google said.

It is Google’s largest acquisition ever, and pushes it deeper into cellphones. Google is already a formidable force in mobile computing thanks to its Android software, the chief challenger to Apple Inc. and its iPhones.

At the same time, the acquisition is largely a defensive one. Google needs Motorola’s trove of 17,000 cellphone patents to defend Android phones against lawsuits by Apple, which accuses them of copying iPhone features …

 

Marketing Study: Social Media Used, Consumed by 93% of B2Bs

The recent 2012 Social Media Marketing Industry report found that more than 93 percent of B2B marketers use social media to market their businesses–a five percent increase over 2010, TopTenWholesale reports.

Furthermore, more than 56 percent of acquired new business partnerships took place using social media, nearly 60 percent saw improved search engine results rankings from social media efforts and about 70 percent gained marketplace intelligence via social networks.

In terms of which platforms preferred by B2B marketers, 87 percent said they used Facebook, 86.6 percent used LinkedIn and 84 percent have Twitter accounts. B2B professionals are also avid bloggers (65 percent) and are adopting Google+ (44 percent) …

SAP Agrees to Acquire Ariba for $4.5 Billion
New York Times
SAP, the German business software giant, has agreed to buy Ariba, a provider of cloud computing services, for $4.5 billion.

Ariba shareholders are being offered $45 a share, representing a premium of nearly 20 percent over the company’s closing price on Monday. SAP, which battles with Oracle as the titans in enterprise software, will be expanding its cloud-based services with the acquisition, which is being done through its American subsidiary. Ariba, based in Sunnyvale, Calif., has become the second-largest cloud vendor by revenue, the companies said …

 

Investor Sues Nasdaq Over Facebook IPO Glitches

Nasdaq OMX Group is facing a lawsuit seeking to represent investors who sought to trade shares of Facebook during its IPO, only to allegedly suffer millions of dollars in losses because of trading glitches. The lawsuit, which seeks class action status, said Nasdaq “badly mishandled” the “hotly anticipated” IPO, leading to confusion over whether buy and cancel orders were executed and resulting in trading losses as Facebook share prices fluctuated wildly throughout the day.

Nasdaq reps were not immediately available for comment. A spokeswoman for Facebook declined to comment …

CCOs on the Go: Sony Digital’s Don Levy Exits after 20 Years
Variety
Sony Pictures Digital’s senior VP, communications is ankling the studio after 17 years.
Levy, who leaves Sony June 4, is developing a new family entertainment venture. He will also be a visiting scholar at the U. of Southern California and teach entertainment marketing at Boston U.’s Los Angeles program.

Levy joined Sony in 1995 as an awards campaign consultant and has been the main spokesman for Sony Pictures Imageworks for most of its history.

Steven Argula is the new director of public relations for Sony Pictures Imageworks. He reports to Becky Chaires, senior VP of marketing for Sony Pictures Digital Productions. Olivier Mouroux, who handles PR for Sony Pictures Animation, has been upped to VP, public relations and coroporate communication …

 

Crisis Communications: No Explosives Found on Diverted US Airways Flight
The Los Angeles Times
The crowded US Airways flight from Paris to Charlotte, N.C., had just reached the northeastern tip of Canada when one of the passengers, a French citizen who was born in Cameroon, handed a flight attendant a cryptic note that said she had something hidden inside her body.

Alarmed that the woman could be carrying a surgically implanted bomb, the crew notified authorities. U.S. fighter jets were scrambled, and the pilot was told to make an emergency landing in Bangor, Maine.

State and federal agents met the plane when it landed, and the woman was arrested. An initial investigation has found no bomb on the plane, and no immediate sign that the woman had explosives somehow secreted inside her, said a senior law enforcement official who was not authorized to speak publicly …

NAB Challenging Constitutionality of FCC’s New Political-Ad Rules

The National Association of Broadcasters is challenging the constitutionality of new FCC rules requiring local TV stations to put information about political advertising online, it said on Tuesday. The new rules are “arbitrary, capricious, in excess of the commission’s statutory authority, inconsistent with the First Amendment, and otherwise not in accordance with the law,” the NAB said in a May 21 petition at the U.S. Court of Appeals for the District of Columbia.

In the documents the NAB filed with the court, the association did not spell out in detail its specific problems with the regulations adopted by the FCC April 27 …

Ryan Kutscher, who previously served as a creative director at CP&B, and Matt MacDonald, who’s been executive creative director at JWT, New York, have been named co-chief creative officers of the network’s flagship New York office.
